Plain English summary: By using Sales Hub Cloud you agree to these terms. Pay on time, use the service lawfully, own your data. We limit our liability and can suspend accounts that breach these terms.

1. Agreement to these terms

By accessing or using Sales Hub Cloud ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

These Terms form a legally binding agreement between you (or your organisation) and Zayn Productions Ltd (Company No. 16892199), trading as Sales Hub Cloud, registered at 1 Alvin Street, Gloucester, England, GL1 3EJ ("we", "us", "our").

2. The service

Sales Hub Cloud is a software-as-a-service (SaaS) CRM and client management platform. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service during your subscription period, subject to these Terms.

We reserve the right to modify, update, or discontinue features of the Service at any time. Where we make material changes, we will provide reasonable notice.

3. Accounts and organisations

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your password and account credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • Each organisation operates in a fully isolated environment. You must not attempt to access another organisation's data.
  • You are responsible for all activity that occurs under your account and for all users you add to your organisation.

4. Free trial

We offer a 14-day free trial on all plans. No credit card is required to start a trial.

  • Trial accounts have full access to the features of the selected plan for 14 days.
  • At the end of the trial period, your account will be paused unless you subscribe.
  • Trial data is retained for 30 days after expiry, after which it may be permanently deleted.
  • We reserve the right to terminate or refuse a trial at our discretion if we believe the Service is being misused.
  • Only one free trial per organisation is permitted.

5. Subscriptions and payment

Plans and pricing

Subscriptions are billed on a per-user, per-month basis. Current pricing is published at saleshubcloud.co.uk/#pricing. Prices are in GBP and exclude VAT where applicable.

Billing

  • Subscriptions renew automatically at the start of each billing period.
  • You authorise us (or our payment processor) to charge the payment method on file.
  • If payment fails, we will make reasonable attempts to collect and may suspend access after 7 days of non-payment.

Cancellation and refunds

  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial months or unused periods, except where required by law.
  • If we terminate your account for breach of these Terms, no refund will be issued.

Price changes

We may change our pricing with at least 30 days' notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.

6. Acceptable use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or bulk communications without consent
  • Violate any applicable law or regulation, including UK GDPR and data protection law
  • Harass, abuse, or harm any person
  • Attempt to gain unauthorised access to any part of the Service or other users' data
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to store or transmit malicious code
  • Resell, sublicense, or white-label the Service without our written permission
  • Use automated scripts or bots to access the Service in a way that causes disproportionate load

Breach of these provisions may result in immediate suspension or termination of your account.

7. Your data

You retain full ownership of all data you upload or create in Sales Hub Cloud ("Your Data"). We process Your Data only on your instructions to provide the Service.

You are responsible for ensuring that Your Data — including your clients' personal data — is processed in accordance with all applicable data protection laws (including UK GDPR). You confirm that you have a lawful basis for storing and processing your clients' personal data in the Service.

Our Data Processing Agreement, which forms part of these Terms for business customers, is available on request at [email protected].

On termination of your account, you may request an export of Your Data within 90 days. After 90 days, we may permanently delete it.

8. Intellectual property

The Sales Hub Cloud platform, including its design, code, features, and branding, is owned by Zayn Productions Ltd and protected by intellectual property law. These Terms do not grant you any rights to our intellectual property beyond the limited licence to use the Service.

You grant us a limited licence to host, process, and display Your Data solely as necessary to provide the Service.

9. Availability and support

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible.

Support is provided via email at [email protected]. Priority support is available on the Scale plan.

10. Limitation of liability

Important: Please read this section carefully as it limits our liability to you.

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
  • Our total aggregate liability to you in any 12-month period will not exceed the fees you paid to us in that same period.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

11. Termination

Either party may terminate the agreement at any time:

  • You may cancel your subscription at any time via your account settings or by contacting us.
  • We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or if we reasonably suspect fraudulent or harmful activity.

On termination, your access to the Service will cease. Provisions that by their nature should survive termination (including data ownership, IP, and liability) will continue to apply.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the platform at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.
